Terms of Service

Thank you for using Planosys!

When we say “Planosys”, “we”, “our”, “us”, “service” or “services” in this document, we are referring to the Planosys analytics script and the Planosys website.

We may update these Terms of Service from time to time.

By using the service now or in the future, you agree to the most recent version of these Terms. This applies to all existing and future features. If we do not enforce a provision at any time, it does not mean we waive our right to enforce it later. These Terms include limitations of liability. If you do not agree to any part of these Terms, you must not use the service.

Account terms

You are responsible for maintaining the security of your account and password. Planosys cannot and will not be liable for any loss or damage resulting from your failure to comply with this obligation.

You are responsible for all activity that occurs under your account, including actions by users you authorize.

You may not use the service for any illegal purpose or in violation of laws applicable in your jurisdiction.

You must provide your valid email address during the signup process.

Accounts registered by bots or automated methods are not permitted. You must be a human.

Payment and refunds

Subscription fees are billed in advance and governed by our refund policy. Check this link for details.

After the trial period, payment is required in advance to continue using the service. If payment is not made, your account may be frozen until payment is received.

When upgrading from a trial to a paid plan, billing starts immediately on the day of upgrade.

Paid subscriptions are billed automatically via supported payment methods.

Payments are processed by our payment processor Paddle acting as Merchant of Record. Taxes are collected and remitted to tax authorities by Paddle where applicable. See Paddle’s Terms of Use for details

Paddle provides customer service inquiries and handles refunds.

Cancellation and account status

If you cancel your subscription before the end of your billing period, access continues until the period ends. After expiry of the subscription or trial period, analytics data may become inaccessible.

We reserve the right to suspend or inactivate accounts at any time, including for violations of these terms or to protect the service or its users.

We reserve the right to refuse service to anyone for any reason at any time.

Abuse of Planosys staff or customers may result in immediate suspension or restriction of access.

If a subscription expires or is cancelled, the account may become inactive. Analytics data may be deleted after a reasonable period. We may retain limited account information such as email address and billing records for legal, accounting, or compliance purposes.

Modifications to the service and pricing

We may modify or discontinue any part of the service temporarily or permanently, with or without notice.

We may change pricing. Price changes will not affect your current billing cycle but may apply at renewal.

Planosys is not liable to anyone for service modifications, price changes, suspensions, or discontinuations.

Content ownership, copyright and trademarks

You are solely responsible for content and data you submit.

We claim no ownership over your analytics data. All site data remains yours.

Feedback you provide may be used by Planosys without compensation or attribution.

The Planosys name, logo, and service design are protected. You may not reproduce or resell the service without permission.

You agree to comply with applicable privacy and data protection laws and must not send sensitive personal information through the service.

General conditions

The service is provided on an “as is” and “as available” basis. We do not guarantee error-free or uninterrupted operation.

The service may rely on third-party providers and infrastructure. Planosys is not responsible for the acts, omissions, availability, security, or performance of third-party services.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

These Terms constitute the entire agreement between you and Planosys and supersede all prior agreements or understandings.

Support is provided via email on a best-effort basis. Authorized staff may access data only for support and security purposes.

Liability

You expressly understand and agree that, to the maximum extent permitted by law, Planosys shall not be liable, in law or in equity, to you or to any third party for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, business interruption, or other intangible losses, even if Planosys has been advised of the possibility of such damages.

This limitation of liability applies to damages arising from: (i) your use of or inability to use the service; (ii) the cost of procurement of substitute services; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on or related to the service; or (v) any other matter relating to these Terms or the service, whether based on contract, tort (including negligence), strict liability, or any other legal theory.

To the maximum extent permitted by law, Planosys’ total liability arising out of or relating to the service shall not exceed the amount paid by you to Planosys in the three (3) months preceding the claim.

By choosing to use Planosys, you acknowledge that you are making a decision to rely on a software service. While we take security, reliability, and privacy seriously and make reasonable efforts to operate the service responsibly, no software service is entirely risk-free.

If your use of the service does not meet your expectations or results in loss, you agree that such risk is assumed by you and not by Planosys.

These Terms shall be governed by and construed in accordance with the laws of India. Subject to applicable law, courts located in Bhubaneswar, Odisha, India shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms or the service.
